Granting Title of Land to Sante Fe Pacific Railroad

To all to whom these presents shall come, Greeting:

WHEREAS, by the Act of Congress approved July 27, 1866, entitled “An Act granting lands to aid in the construction of a Railroad and Telegraph Line from the States of Missouri and Arkansas to the Pacific Coast,” there was granted to the Atlantic and Pacific Railroad Company, its successors and assigns for the purpose of aiding in the construction of said railroad and telegraph line to the Pacific Coast, “every alternate section of public land not mineral, designated by odd numbers to the amount of twenty alternate sections per mile on each side of said railroad line, as said Company may adopt through the Territories of the United States and ten alternate sections of land per mile on each side of said railroad, whenever it passes through any State and whenever on the line thereof the United States have full title, not reserved, sold, granted, or otherwise appropriated and free from pre-emption or other claims or rights at the time the line of said road is designated by a plat thereof filed in the office of the Commissioner of the General Land Office;” and

WHEREAS, It is further provided by said Act that “Whenever, prior to said time any of said sections, or parts of sections, shall have been granted, sold, reserved, occupied by homestead settlers or pre-empted or otherwise disposed of, other lands shall be selected by said Company in lieu thereof under the direction of the Secretary Of The Interior in alternate sections, and designated by odd numbers, not more than ten miles beyond the limits of said alternate sections, and not included in the reserved numbers;” and

WHEREAS, Official statements bearing dates December 17, 1880, April 19, 1891, January 7, and December 16, 1882, and November 3, 1883, have been filed in the General Land Office, showing that the Commissioners appointed by the President under the provisions of the fourth section of said Act of Congress, approved July 27, 1866, have reported to him that the line of said railroad and telegraph from a point in township eight north of range two east, Territory of New Mexico, and ending at a point on the west bank of the Colorado River in the State of California, has been constructed and fully completed and equipped in the manner prescribed by the said Act of Congress; and

WHEREAS, Certain tracts of land have been selected by the duly authorized land agent of the said Atlantic and Pacific Railroad Company, to its successor in interest as shown by his original list approved by the local officers and now on file in the General Land Office and

WHEREAS, It is shown by evidence filed in the Secretary of the Interior, that the Santa Fe Pacific Railroad Company, under a purchase at foreclosure sale of the property and rights of the Atlantic and Pacific Railroad Company and by compliance with the provisions of the Act of Congress approved March 3, 1897 (29 Stat., 322), became the lawful successor in interest of the said Atlantic and Pacific Railroad Company; and

WHEREAS, The said tracts of land lie coterminous with the constructed line of road and are particularly described as follows, to whit:

NOW KNOW YE, That the UNITED STATES OF AMERICA, in consideration of the promises, and pursuant to the said Acts of Congress, HAVE GIVEN AND GRANTED and by these presents DO GIVE AND GRANT, unto the said

SANTA FE PACIFIC RAILROAD COMPANY

Successor in interest to the Atlantic and Pacific Railroad Company, and to its successors and assigns, the tracts of land selected as aforesaid and described in the foregoing; TO HAVE AND HOLD the said tracts with the appurtenances thereof unto the said

SANTA FE PACIFIC RAILROAD COMPANY

successor as aforesaid, and to its successors and assigns, forever.
